1. Acceptance of Terms
By accessing or using the Moulak platform (“Platform”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must not use our Platform. These Terms apply to all visitors, users, agents, property owners, and others who access or use the Platform.
2. Use of the Platform
The Platform is intended for lawful purposes only. You agree not to use Moulak to post false or misleading property listings, engage in fraudulent transactions, impersonate another person or entity, or violate any applicable Iraqi or international law. Moulak reserves the right to suspend or terminate access for any user who breaches these Terms.
3. Property Listings
All property listings are provided by registered agents and property owners. Moulak acts as a marketplace and does not directly own, sell, rent, or lease any property listed on the Platform. We make reasonable efforts to verify listing accuracy, but we do not guarantee the completeness or accuracy of any listing. Users are encouraged to verify all listing details independently before making decisions.
4. User Accounts
To access certain features, you may be required to register for an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. Notify us immediately at hello@moulak.iq if you suspect unauthorised use of your account.
5. Agent & Owner Accounts
Agents and property owners who subscribe to Moulak's paid listing plans are subject to additional terms outlined in the Agent Agreement. Subscription fees are non-refundable unless otherwise stated. Moulak may remove listings that violate our quality standards at any time without prior notice.
6. Intellectual Property
All content on the Platform, including logos, text, images, and software, is the property of Moulak or its licensors and is protected under applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
7. Limitation of Liability
To the fullest extent permitted by law, Moulak shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability in any matter arising from these Terms shall not exceed the amount paid by you to Moulak in the three months preceding the claim.
8. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and safeguard your personal data.
9. Changes to Terms
Moulak reserves the right to amend these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Iraq. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Baghdad, Iraq.
